§ 221 Suspension[1]

(1) Who puts a person

  1. in a helpless position or
  2. abandons them in a helpless situation, although he has them in his care or is otherwise obliged to assist them,

and thereby exposing them to the risk of death or serious damage to health, is punished with imprisonment from three months to five years.

(2) A prison sentence of one year to ten years is to be applied, if the perpetrator

  1. commits the act against his child or a person, entrusted to him for upbringing or care for the lifestyle, or
  2. through the act serious damage to the health of the victim is caused.

(3) If the offender causes the victim's death through the act, the penalty is imprisonment for no less than three years.

(4) In less serious cases under Paragraph 2, imprisonment of six months to five years is to be recognized, in less serious cases under Paragraph 3, imprisonment of one year to ten years.

This paragraph could be applied wherever small children are forcibly mistreated by HGM and their health is seriously damaged. Since boys in Germany no longer have the right to speak out against their own genital mutilation due to the German Circumcision Act, the helpless situation is actually imposed on all male children in Germany by the German Circumcision Act itself by the legislature. Since even death can be a consequence of HGM, doctors and circumcisers should listen carefully to sentence 3 at the latest.
