§ 226 Serious assault[1]

(1) Does the bodily harm result in the injured person

  1. losing sight in one eye or both eyes, hearing, speaking or reproductive ability,
  2. losing an important limb of the body or permanently no longer able to use it, or
  3. being seriously disfigured or in infirmity, paralysis or mental illness or disability lapses,

the penalty is imprisonment from one year to ten years.

(2) If the offender deliberately or knowingly causes one of the consequences specified in paragraph 1, the penalty shall not be less than three years' imprisonment.

(3) In less serious cases of paragraph 1, imprisonment of six months to five years is to be recognized, in less serious cases of paragraph 2, imprisonment of one year to ten years.

This section criminalizes grievous bodily harm. It should always be in focus when judging HGM, because HGM is serious bodily harm.
