Art. 123 - Simple assault[1]

  1. Anyone who intentionally harms a person's body or health in any other way will, on request, be punished with imprisonment for up to three years or a fine.
    In minor cases, the judge can reduce the sentence (Art. 48a ).
  2. The penalty is imprisonment for up to three years or a fine, and the perpetrator will be prosecuted ex officio
    if he uses poison, a weapon or a dangerous object,
    if he commits the act on a defenseless person or on a person who is under his care or for whom he has to care, namely a child,
    if he is the spouse of the victim and the act was committed during the marriage or up to one year after the divorce,
    if he or she is the registered partner of the victim and the act was committed during the duration of the registered partnership or up to one year after its dissolution,
    if he is the victim's heterosexual or homosexual partner, provided they live in the same household for an indefinite period and the offense was committed during this period or up to one year after the separation.
